ART no longer valid, ensure future deals are transparent


THE Institute for Strategic Analysis and Policy Research (Insap) welcomes the statement by Investment, Trade and Industry (Miti) Minister Datuk Seri Johari Abdul Ghani that the Malaysia-US Agreement on Reciprocal Trade (ART) is no longer valid following the recent US Supreme Court ruling on related trade measures. The decision reflects structural concerns that industry stakeholders and policy analysts had previously raised regarding ART’s scope, transparency, and review mechanisms.

While the ART is no longer applicable, Malaysia must remain vigilant regarding ongoing and future trade scrutiny. The US may continue to use legal tools such as Section 301 investigations, which could examine foreign trade practices deemed discriminatory or harmful to US commerce.
