Call to go easy on asset seizure

KOTA KINABALU: While supporting stiffer penalties for drunk drivers who cause deaths, asset seizure should not be carried out indiscriminately, says the National Consumer Foundation Malaysia.

Its Sabah chapter chairman David Chan (pic) said the foundation viewed drink-driving as a serious and irresponsible act.

“Offenders who cause death or permanent disability must face appropriate legal consequences, including severe punishment and compensation for victims and their families,” he said.

However, he questioned the proposed seizure of assets belonging to offenders, saying the measure could penalise their innocent family members.

“We fully support tougher punishment for drunk drivers who destroy innocent lives.

“However, if an offender’s property, savings and belongings are automatically confiscated, who will take care of the innocent spouse, young children and elderly parents who depend on those assets for their daily survival?” said Chan.

He said the proposal should be carefully evaluated, with feedback from legal experts, consumer associations, road safety organisations and other stakeholders.

“The government should consider a balanced framework that ensures offenders are held financially accountable while preventing innocent spouses and children from being pushed into poverty or homelessness.

“Punishment must be directed at those who commit the offence, not extended indiscriminately to innocent family members.

“We must not create another group of victims while seeking justice for those already affected,” he added.

Chan said the government must consider the humanitarian consequences of enforcement measures that could affect innocent family members, while ensuring offenders were held accountable for their actions.

“Imagine a situation where a convicted drunk driver is imprisoned and the family’s house, savings and other essential assets are confiscated.

“What will happen to the spouse and children? Who will provide them with food, education, shelter and other necessities?” he said.

Chan stressed that victims of drink-driving accidents and their families must receive appropriate compensation, particularly in cases involving permanent disability, loss of income or the death of a family’s breadwinner.

He said any asset seizure mechanism should follow proper judicial procedures, with adequate safeguards to protect legally owned assets and ensure innocent dependants’ reasonable living needs are met.

“Stricter enforcement, public awareness campaigns and responsible driving education are also crucial to preventing alcohol-related road accidents,” he added.
