Ex-UiTM Holdings CEO claims trial

SHAH ALAM: A former UiTM Holdings Sdn Bhd CEO claimed trial at the Sessions Court here for criminal breach of trust involving RM37mil, linked to a solar power generation project in Pahang.

Azlizan Fadzli, 53, who was wheeled into the courtroom, pleaded not guilty after the charge was read out before judge Mohd Nasir Nordin here yesterday.

He was accused, in his capacity as the UiTM Holdings CEO, of committing CBT on the RM37,374,612.68, by dishonestly misappropriating it by making payments for other purposes.

The money was meant as an investment into the development of a large-scale 50MW solar photovoltaic power generation project in Gambang, Pahang.

He allegedly committed the offence at Affin Bank Bhd, UiTM Shah Alam, Menara Sultan Abdul Aziz Shah, between Feb 2 and Oct 2, 2017.

Azlizan was charged under Section 409 of the Penal Code and faces imprisonment between two and 20 years, whipping and may be liable to a fine, if convicted.

Deputy public prosecutor Law Chin How told the court that the case involved a large amount of public funds and the reputation of UiTM Holdings.

He said a RM100,000 bail in one surety would be reasonable.

Azlizan’s lawyer Hasshahari Johari Mawi pleaded for a lower amount. He said his client had a stroke which caused impairment to the mind and body.

“His wife has to support seven children aged between 14 and 21,” Hasshahari said, adding that his client had cooperated at all material times.

“We ask for bail to be set at RM20,000 in two sureties. The accused can report his attendance to the authorities once every three months,” Hasshahari said.

Judge Mohd Nasir fixed bail at RM50,000 in two sureties.

He also allowed other bail conditions where the accused was ordered to surrender his passport to the court and to report his attendance to the Malaysian Anti-Corruption Commission office once every three months.

“The accused must refrain from disturbing prosecution witnesses,” Mohd Nasir added.

The case is set for mention on Nov 3.
