IPOH: A sand mining company director and a lorry driver were fined RM12,500 each by the Sessions Court here after pleading guilty to storing over 2,000 litres of diesel without a licence about two years ago.
Judge Ainul Shahrin Mohamad imposed the sentence on company director R. Prakash, 43, and lorry driver V. Ammasi, 30, and ordered them to serve 12 months’ imprisonment if they failed to pay the fine.
According to the charge sheet, both the accused, on Nov 13, 2024 at about 7.30am at the premises of Trade Shipper Resources in Batu Gajah, were found to have in their possession 2,115 litres of diesel which is a controlled item without license stored in two containers tanks on a lorry, 15 jerry cans, and two blue plastic drums.
The charge was framed under Section 21 of the Control of Supplies Act 1961 (Act 122) and is punishable under Section 22(1) of the same Act, which provides for a fine of up to RM1mil, imprisonment of up to three years, or both.
The Domestic Trade and Cost of Living Ministry prosecuting officer N. Shamani requested the court to impose a fine of RM12,500 for each accused.
Both the accused were not represented.
Prakash during mitigation requested for a lower fine stating that his business was not doing well.
Both paid the fine.
According to the statement of the facts, on Nov 13, 2024 the enforcement team inspected the company at a sand mining site in Batu Gajah, where they found both the accused there.
During the inspection, officers allegedly found a lorry pumping liquid suspected to be diesel into a jerry can.
The two men failed to produce a valid licence, permit or written authorisation from the Supply Controller to possess or deal in the controlled goods.
