KOTA KINABALU: A security guard was sentenced to 10 years' jail and three strokes of the cane by the Sessions Court here after pleading guilty to sexually assaulting a child.
Mohd Firdaus Basir, 34, was sentenced to seven years in prison and one stroke of the cane for hugging and kissing the victim, aged 11 years and nine months, with sexual intent at 5.50am on Jan 13 at a school in Tuaran, about 40km from here.
The offence was framed under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for imprisonment of up to 20 years and caning upon conviction.
Sessions judge Amir Shah Amir Hassan also ordered an additional sentence of three years' jail and two strokes of the cane under Section 16(1) of the Act, which provides for imprisonment of up to five years and a minimum of two strokes.
Firdaus was ordered to serve both jail terms consecutively from the date of his arrest on Feb 27.
In meting out the sentence on Tuesday (June 16), the court also ordered Firdaus to undergo rehabilitation counselling throughout his imprisonment and to be placed under police supervision for two years after completing his sentence.
The victim was waiting in the school compound on the day of the incident when Firdaus invited her to the canteen.
Initially, the victim refused and said she was already full, but the accused insisted.
He then told the victim he wanted to retrieve something from his car and she followed him to the parking lot, where he committed the offence.
The victim managed to escape and was reported to have avoided the accused after that out of fear.
However, at around 6am on Jan 28, Firdaus approached her again and tried to entice her with a letter, a bottle of perfume and a packet of biscuits.
The victim then informed the discipline teacher and a police report was lodged.
