‘Court must protect cops in probe’


PUTRAJAYA: The High Court has a duty to protect the police in how they go about conducting their investigations, the Court of Appeal was told.

Senior Federal Counsel Liew Horng Bin said police’s duty – for preservation of the peace – was owed to the public and it did not give rise to duties of care to individual members of the public.

SFC Liew further said the High Court’s finding that there was “a fundamental failure to investigate” and “a complete abdication of investigative responsibility” was wrong and not supported by evidence during the trial.

SFC Liew was submitting in the government’s appeal against a High Court decision in a lawsuit brought by the family of deceased Dutch model Ivana Smit.
