Penang exco rep Fahmi innocent until proven guilty, to carry out duties as normal, says CM


GEORGE TOWN: Penang executive councillor Fahmi Zainol who was charged with hurting his wife will carry out his duties as normal.

Chief Minister Chow Kon Yeow said Fahmi will continue to carry out his role as the state agrotechnology, food security and cooperative development committee chairman.

"We only came to know (about the charge) this afternoon. We will let the court decide the case.

"There will be no leave of absence, he will carry out his duties," said Chow to the press after launching a Bazaar Ramadan at Prangin Mall on Friday (Feb 27).

Chow was responding to questions by the press on Fahmi's status as a state exco member and if he would need to take a leave of absence from his role during the case proceedings.

Chow said Fahmi would not be taking a leave of absence.

"The state exco would discuss the matter during their next meeting (next week).

"We cannot act above the court. He (Fahmi) is not guilty until found guilty.

"He is innocent until the court makes a decision," he said.

On Friday (Feb 27) morning, the Pantai Jerejak assemblyman claimed trial at a Balik Pulau Magistrate's court to voluntarily causing hurt to his wife.

Based on the charge sheet, the 35-year-old is accused of intentionally causing injury to his wife, Nur Hidayah Abd Jabar, 35, at a house in Persiaran Pantai Jerejak 11, Bayan Lepas, at about 10pm on Feb 22.

The charge was framed under Section 323 of the Penal Code, read together with Section 326A of the Penal Code.

Section 323 carries a maximum penalty of one year's imprisonment, a fine of up to RM2,000, or both, upon conviction.

Section 326A states that any person who hurts his spouse shall be punished with imprisonment for up to twice the term prescribed under Section 323.

Fahmi was released on bail.
