Man and his friend charged with sexually abusing wife in Tuaran


KOTA KINABALU: A man and his friend have been charged with sexually abusing the former's wife in Tuaran near here.

Both accused, who were unrepresented, pleaded not guilty to the charges before Sessions Court Judge Amir Shah Amir Hassan on Wednesday (Feb 4).

The husband, 35, was charged under Section 377CA and Section 109 of the Penal Code with sexual connection by object without consent and abetting his 34-year-old friend respectively while the friend was also charged under Section 377CA.

Deputy Public Prosecutor Bryan Francis asked the court to deny bail, saying the victim's husband lived with her while his friend lived nearby and could disrupt or tamper with the prosecution witness.

In mitigation, the husband told the court that he had children to care for and claimed that his wife had made the accusations because she wanted a divorce.

The second accused, the husband's friend, told the court that he does not reside in the same area and denied the charge.

The judge set March 4 for case management and rejected both men's application for bail.

The court also advised both accused to obtain legal representation for future court proceedings.
