High Court sets Jan 26 decision on challenge over rejected Sabah 40% revenue motion

KOTA KINABALU: The High Court here has fixed Jan 26, 2027, to decide on a leave application for judicial review filed by Kapayan assemblyman Chin Tek Ming.

He is challenging the decision of Sabah State Assembly Speaker Datuk Seri Kadzim M. Yahya to reject his private motion concerning Sabah’s constitutional entitlement to 40% of the Federal Government’s net revenue.

Kota Kinabalu High Court Judge Datuk Celestina Galid Stuel fixed the date for the application for leave to commence judicial review after hearing oral submissions from the applicant, the Federal Government, the Sabah State Government and the State Assembly Speaker on Wednesday (Nov 4).

Chin told the court that his original intention for his private member’s motion was simply to empower the Sabah State Government to pursue a resolution through negotiations and legal avenues to demand payment from the Federal Government of Sabah’s 40% entitlement to net revenue for the period from 2022 to 2025 and subsequent years.

However, Chin noted that both the Sabah State Government and the Federal Government objected to the application.

Chin said he hoped the Court would deliver a decision consistent with a clear resolution to the dispute over Sabah’s constitutional entitlement to 40% of Federal net revenue.
