Six men plead not guilty to rioting, causing grievous hurt in viral Mount Austin case


JOHOR BARU: Six men claimed trial at the Magistrate and Sessions Courts here to charges of rioting with weapons and causing grievous hurt, in connection with an incident that went viral on social media last month.

In the Sessions Court, the accused - Choy Soon Chye, 41; Soh Say Shin, 36; Soo Toh Siang, 30; Calvin Phua Khim Hau, 29; Yap See Hong, 26; and Tan Shen Qi, 21 - were charged before Sessions Judge Datuk Ahmad Kamal Arifin Ismail on Friday (Jan 2).

According to the charge sheet, the six allegedly acted with common intention to cause grievous hurt to Low Chun Yong, 28, using weapons capable of causing death, including a meat cleaver, a taser gun, a plastic chair and an iron rod.

The alleged offence took place in front of a restaurant in Taman Mount Austin at about 3.30am on Dec 27.

They were charged under Section 326 of the Penal Code read together with Section 34, which carries a maximum imprisonment of 20 years and caning or a fine upon conviction.

All six also pleaded not guilty before Magistrate Muhammad Fitri Mokhtar at the Magistrate’s Court to a charge of taking part in a riot and possessing weapons that could be used to attack.

The offence was allegedly committed at the same location, date and time. They were charged under Section 148 of the Penal Code, which carries a maximum imprisonment of five years or a fine or both.

Deputy public prosecutors Mohamad Afdhallan Syafiq Azmy and Siti Aishah Latif prosecuted the cases, while lawyers T. Haressh and Amarpreet Singh represented the accused.

The court allowed bail of RM13,500 for each accused with additional conditions, including three sureties per person, surrendering their passports and reporting to the nearest police station.

The cases have been fixed for mention on Feb 3 for the handing over of documents.
