Chinese national charged with deceiving Johor DOE to evade enforcement action

JOHOR BARU: A Chinese national has been charged at the Sessions Court here with deceiving the Johor Environment Department (DOE) over the ownership of four shipping containers.

According to the charge sheet, 48-year-old company director Chen Zhenlong allegedly conspired with one other person to deceive the department on Jan 19, 2022.

Chen was said to have lied about his company’s ownership of the containers by claiming that they belonged to another firm.

He apparently did so to avoid action under the Environmental Quality Act 1974.

The charge, read to him in Mandarin, was framed under Section 109 of the Penal Code, read together with Section 417, and is punishable with a jail term of up to five years, or a fine, or both, upon conviction.

Malaysian Anti-Corruption Commission (MACC) prosecuting officer Rais Adhar Ramli requested bail of RM20,000 for the accused, a foreign national.

Chen’s lawyer Jeremy Chan appealed for a lower amount as his client had to provide for his wife and three children in China.

“Because of his business in Malaysia, he stays with his friend in Taman Cempaka here, and he is here more than... in his home country,” he told Sessions judge Ahmad Kamarul Arifin Ismail during proceedings on Tuesday (Sept 23).

The court set bail at RM20,000 with one Malaysian surety and fixed Oct 29 for next mention.
