Two men fined RM3k for lewd posts online


SEPANG: Two men were fined RM3,000 each by the Sessions Court here after pleading guilty to charges of posting obscene comments on Facebook three years ago.

Sessions Court judge Ahmad Fuad Othman, in meting out the fine, also ordered that Mohd Shahrulamin Abdullah, 41, and Mohd Rasul Abd Razak, 44, be jailed for a month if they failed to pay the fine.

Another accused, Mohd Nasir Kadir, 57, pleaded not guilty to a similar charge for posting an obscene comment on Facebook at 10.29pm on Dec 15, 2022.

The court has scheduled his case for May 23 and granted him bail of RM3,000.

The two pleaded guilty to charges related to making obscene comments on Facebook regarding a news portal’s post about the infant daughter of a Malaysian medical specialist employed in the United Kingdom.

The first accused, Mohd Shahrulamin, committed the offence at 10pm on Dec 20, 2022, while the second, Mohd Rasul, did so at 4.30pm on Dec 29, 2022.

All three of them were charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, which is punishable under Section 233(3) of the same Act.

This stipulates a maximum fine of RM50,000, along with an additional fine of RM1,000 per day if the offence continues, or a jail term of up to one year, or both, if found guilty.

The case was conducted by Malaysian Communications and Multimedia Commission prosecuting officer Nur Nazhzilah Mohammad Hashim while the three accused were unrepresented.
