Factory worker claims trial to sexually assaulting minor


SEREMBAN: A 47-year-old factory worker has pleaded not guilty at the Sessions Court here to two charges of sexually assaulting an underaged girl.

A. Murugeswaran entered the plea after the charges were read to him before judge Surita Budin on Tuesday (Oct 29).

For the first charge, he allegedly committed physical sexual assault against the victim, who was then 16 years and 10 months old, by forcing her to perform a sexual act on him.

He allegedly committed the offence at around 5pm on May 21 in a house in Seremban 2 near here.

Murugeswaran was charged under Section 14(b) of the Sexual Offences Against Children 2017 Act which carries a jail term of up to 20 years and whipping upon conviction.

For the second charge, the accused allegedly committed a sexual act on the same victim without her consent.

He allegedly committed the offence at around the same time and date, and was charged under Section 377CA of the Penal Code which provides for between five and 30 years' jail and whipping upon conviction.

DPP Nurul Balkis Zunaidi then asked the court for a new mention date as the prosecution had yet to receive the final medical report.

Judge Surita then fixed Dec 4 for mention.

The accused was represented by Joseph Mathews.
