Six people accused of drug, firearm offences in Johor


JOHOR BARU: Six people were charged at the Magistrate Courts, Sessions Court and Sultanah Aminah Hospital (HSA) here for allegedly possessing drugs and firearms.

The six accused are wheelchair-bound Mohammad Raffi Yahya, 35, Mohamad Zaidi Sani, 34, Afiq Zaidi, 23, and three siblings - Siti Nurfatimah Sottor, 32, Muhammad Taufik Sallehudin, 30, and Siti Nurshafina, 24.

Only Mohammad Raffi was charged at HSA as he was getting treatment for tuberculosis and had tested positive for Covid-19.

All six were charged in front of Magistrate Hidayatul Syuhada Shamsudin, Magistrate R. Salini and Judge VM Mabel Sheela on Wednesday (Sept 27).

Muhammad Taufik Sallehudin and Mohamad Zaidi were accused of trafficking 59.88g of methamphetamine at a house along Jalan Lading 10 in Taman Puteri Wangsa here on Sept 19 at around 2.15am.

They allegedly committed an offence under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and if found guilty can be sentenced under Section 39B(2) of the same Act, which carries the death penalty or lifetime imprisonment and not less than 15 strokes of the cane.

The duo were also accused of possessing 14.81g of cannabis at the same place, time and date, which is an offence under Section 6 of the Dangerous Drug Act 1952 and can be sentenced under Section 6 of the same Act, which is read together with Section 34 of the Penal Code.

The offence carries a fine of not more than RM20,000, imprisonment of not more than five years or both upon conviction.

Meanwhile, Siti Nurfatimah was accused of possessing 665g of ketamine at a house along Jalan Gunung in Taman Gunung Emas near Ulu Tiram here at around 9.15am on Sept 19.

She allegedly committed an offence under Section 12(2) of the Dangerous Drug Act 1952 and can be sentenced under Section 12(3) of the same Act, which carries a jail term of not more than five years, a fine not more than RM100,000 or both upon conviction.

Siti Nurfatimah was also accused of trafficking 81g of Yaba pills and 106g of methylenedioxy-methamphetamine (MDMA) at the same time, date and place.

She was charged under Section 39B(1)(a) of the Dangerous Drug Act 1952 and can be sentenced under Section 39B(2) of the same Act.

Siti Nurfatimah, together with Siti Nurshafina, Mohammad Raffi and Afiq were then charged for trafficking 27,539g of cannabis at a house along Jalan Bestari 33/2 in Taman Bestari Indah here at around 2am on Sept 19.

All four were also accused of trafficking 1.818kg of heroin and 1.944kg of methamphetamine at the same place and time.

They were charged under Section 39B(1)(a) of the Dangerous Drug Act 1952 and can be sentenced under Section 39B(2) of the same Act.

They were again charged for allegedly possessing 136 live bullets at the same place, time and date, which may give rise to a reasonable presumption that they intended to use the ammunition for an unlawful purpose.

They allegedly committed an offence under Section 33 of the Firearms Act 1960, which is read together with Section 34 of the Penal Code where it carries not more than seven years imprisonment a fine of not more than RM10,000 or both and can be whipped.

The four were also charged for allegedly possessing a Colt pistol with one magazine, an STI GP6 pistol with one magazine, a silver-coloured revolver and a Glock pistol with one magazine, which is an offence under Section 7(1) of the Firearms Act (Heavier Penalty) 1971 (Act 37) and read together with Section 34 of the Penal Code.

No plea was recorded from all six of them and the Magistrate courts have set Nov 8, Dec 21 and Jan 29, 2024 for the drug charges next mention while the Session Court has set Oct 26 for the firearms charges next mention.

Deputy Public Prosecutors Wong Zi Qian and Nuraqiilah Ahmad Rofaie prosecuted the cases while lawyer Muhammad Abd Kadir represented all six accused.
