Deaf and mute man gets 35 years for raping, robbing bank officer

KUALA LUMPUR: Justice was served loud and clear as the Sessions Court here sentenced a deaf-mute janitor to a total of 35 years in jail for raping and robbing a bank officer.

Judge Emilia Kaswati Mohamad Khalid sentenced Mohamad Azhan Johan, 28, to prison and six strokes of the cane after he pleaded guilty.

In a sudden change of heart, Azhan on Monday admitted to the three charges brought against him: raping a woman, forcing her to perform oral sex on him, before robbing her of RM100.

Azhan was sentenced to 15 years in prison and three strokes for rape, 13 years in prison and three strokes for forcing the woman to perform oral sex, and another seven years for robbery.

As the sentences were to be served concurrently, Azhan will be in prison for 15 years.

All the offences occurred between 7am and 7.15am on Sept 12, in a toilet in Menara UAB, Jalan Tun Perak here where both Azhan and the victim worked.

According to the statement of facts, Azhan had taken the same lift as his victim at around 7am.

As the elevator reached the 14th floor, he hit the victim over the head and dragged her to the toilet and locked the door.

There, he forced her to perform oral sex, before and after raping her. He also snatched RM100 from her wallet before fleeing the scene.

His victim, a 38-year-old woman, appeared in court at the sentencing to give her victim impact statement. 

She said the incident made her depressed to the point of wanting to kill herself as everyone working in the building found out about the incident.

“I cannot walk outside again. I have to go through medical and psychological treatment because of this,” she said, holding back tears. 

“I cannot sleep because whenever I am alone I will remember what he did to me. I resorted to taking sleeping pills,” she said, adding that she had to take three months of medical leave after the incident.

The exchange was translated to sign language, with the aid of a Federal Court interpreter Tan Lee Bee.

DPP Nadiah Malek Fauzie urged the court to deliver a harsh punishment as violence was used against the victim.
Azhan, who was unrepresented, pleaded for leniency as he has to support a wife and two children, aged seven and nine.
