Defence in Yazid terrorism trial wants journalist removed as witness

KUALA LUMPUR: The defence team in Yazid Sufaat's terrorism trial is attempting to remove a journalist as witness, citing that her testimony would damage his client's reputation.

Counsel Amer Hamzah Arshad submitted on Tuesday that The Star's journalist S. Tarshini's testimony, in relation to an article she wrote on Yazid three years ago, was not relevant to the trial and would cast aspersions on his clients.

Former Internal Security Act detainee Yazid and cafeteria helper Muhammad Hilmi Hasim faced their second day of trial on Tuesday, over alleged terrorist activities in 2012.

Amer said the article titled "Ex-militant: We send new recruits straight to the frontlines", published on Oct 29, 2012, was highly prejudicial and clearly painted Yazid in a bad light.

Judge Mohd Azman Husin initially allowed the prosecution to continue questioning Tarshini, following deputy public prosecutor Nurdeenie Abdul Rashid counter that Amer's objection was premature.

However, the Judge postponed the hearing after both parties agreed to submit written arguments on whether Tarshini's testimony and news story should be accepted as evidence.

Judge Mohd Azman fixed May 5 to continue the hearing.

Yazid, 50, and Muhammad Hilmi, 34, were on trial for promoting acts of terrorism in Syria, which in turn threatened public safety there.

They face a second charge for being members of terrorist organisation Tanzim Al-Qaeda Malaysia.

The alleged offences occurred at Yazid's house in Ampang between August and October, in 2012.

The first charge under Section 130G(a) of the Penal Code is punishable by up to 30 years prison and a fine, while the second charged under Section 130KA carries a life sentence, upon conviction.

Yazid had been detained under the ISA in December 2001 for alleged ties to the Jemaah Islamiyah terror network, but was released in 2008.
