KUALA LUMPUR: A 52-year-old man has been sentenced to 12 years in prison and five strokes of the cane by the Sessions Court here after pleading guilty to committing incest with his biological daughter, who was 13 at the time, resulting in her giving birth to a child.
Judge Mohd Kafli Che Ali ordered the man to begin serving his prison sentence on Friday (Nov 6), undergo counselling and be placed under police supervision for two years.
The incident took place at a house in Bandar Tun Razak, Cheras, at 12.30am in November 2020, when the victim was 13 years and 10 months old.
The charge was framed under Section 376B of the Penal Code, which provides for imprisonment of between 10 and 30 years and whipping upon conviction.
Deputy Public Prosecutor Noor Shakira Aliana Alias sought a heavy sentence, citing the fact that the victim was the accused's daughter and had become pregnant as a result of the offence, subsequently giving birth to a child who is now five years old.
"After the accused divorced her mother, the victim sought him out because she missed her father.
"However, he betrayed her trust and committed a heinous act against her.
"He then took advantage of her naivety to satisfy his lust, when he should have been the one protecting his daughter," she said.
The accused, who was unrepresented, pleaded for a lighter sentence on the grounds that he suffered from high blood pressure and asthma, which required follow-up treatment.
In a separate Sessions Court, a 35-year-old technician pleaded not guilty to a charge of sexually assaulting his 11-year-old niece at a house in Jalan Klang Lama, Brickfields, here between Sept 29 and Oct 20, 2026.
The man was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for a maximum prison sentence of 20 years and whipping upon conviction.
Judge Muhammad Ilmami Ahmad allowed bail of RM15,000 with one surety, subject to additional conditions that the accused must not interfere with the victim or prosecution witnesses.
He must also report to the police station nearest to his residence once a month until the case is concluded, with the court fixing Jan 18 next year for mention. – Bernama
