SHAH ALAM: The Attorney General’s Chambers (AGC) is appealing the High Court’s decision to acquit a 15-year-old boy who stabbed his schoolmate on grounds of insanity during the act.
The AGC said it filed the notice of appeal at the Court of Appeal on Sept 22.
“After considering the decision by the Shah Alam High Court judge, a notice of appeal has been filed at the Court of Appeal on Sept 22 to appeal against the discharge and acquittal,” it said in a statement yesterday.
On Sept 14, High Court judge Justice Adlin Abdul Majid acquitted the teen of murder and ordered the boy to be detained and treated at Hospital Bahagia Ulu Kinta in Perak at the pleasure of the Sultan of Selangor.
The teen was charged under Section 302 of the Penal Code which carries the death penalty or life imprisonment of up to 40 years with a minimum of 12 strokes of the cane if not sentenced to death.
However, under Section 97(1) of the Child Act 2001, offenders under the age of 18 cannot be sentenced to death.
On Wednesday, Justice Adlin’s 77-page grounds of judgment was published on the judiciary’s website.
In her judgment, she said the court had largely accepted the unchallenged findings of court-appointed consultant forensic psychiatrist Dr Ian Lloyd Anthony, who testified as a defence witness at the trial.
Dr Anthony’s findings were set out in a 27-page psychiatric report which detailed the teen’s mental condition and diagnosed him with early onset of schizophrenia.
The boy, who was 14 and a Form One transition student at the time of the incident, was charged with murdering a 16-year-old female student between 9.20am and 9.35am at the girl’s washroom in the school in Bandar Utama on Oct 14, 2025.
