SEREMBAN: A 50-year-old lorry driver was fined RM30,000 by the Sessions Court here after he pleaded guilty to sending obscene photos and videos of his ex-wife to her current husband via WhatsApp.
The accused, Mohd Suhaimi Yusof, pleaded guilty to all five charges read before Judge Shahrul Rizal Majid.
The court also ordered a 10-month jail sentence if he fails to pay the fine.
According to the charges, Mohd Suhaimi transmitted three photographs and two videos to the victim’s husband on March 22, 2023, from a premises in Mantin.
He was charged under Section 233(1) of the Communications and Multimedia Act 1998 for the improper use of network facilities or network services, punishable under Section 233(3) of the same legislation.
Offenders can be fined up to RM50,000 or jailed for not more than one year or both upon conviction.
Mohd Suhaimi, who was unrepresented, did not mitigate when given the opportunity, telling the court he would accept his fate if sentenced to prison.
He told the court he has four children, three of whom are still in school but are being cared for by his ex-wife.
Before passing sentence, Judge Shahrul Rizal advised the accused to think first before taking any action in future.
“My advice is think carefully about the pros and cons first before you do anything next time,” he said before fining the accused RM6,000 in default of two months’ jail for each offence.
