KUALA LUMPUR: Former deputy general manager of TH Properties Sdn Bhd and former deputy general manager of THP Bina Sdn Bhd, Tengku Kamarolhisham Tengku Kamaruddin, 55, was charged at the Sessions Court here on Thursday (Sept 3).
The accused pleaded not guilty after three charges of abetting criminal breach of trust (CBT) involving RM72,000 in penalty payments were read out before Sessions Court Judge Azura Alwi.
According to the charges, the accused allegedly abetted by deliberately directing that penalty payments collected from contractor Fourth Wave Sdn Bhd be deposited into a bank account.
All three offences were allegedly committed at the Putrajaya Islamic Complex in Presint 3, Putrajaya, and involved penalty payments collected from the contractor for a proposed office complex development in Presint 3.
Tengku Kamarolhisham was charged under Section 109 of the Penal Code, read together with Section 409 of the same law, which carries a jail term of between two and 20 years, whipping and a possible fine upon conviction.
Deputy Public Prosecutor Irna Julieza Maaras offered bail of RM70,000 with one surety for all three charges, with additional conditions for the accused to report to a Malaysian Anti-Corruption Commission (MACC) office every month, surrender his passport to the court until the case is concluded and not interfere with or contact any prosecution witnesses.
Lawyer Muhammad Naqib Aiman Mohd Faizal, representing the accused, sought a lower bail amount, saying his client was now working as a businessman and supported six children aged between 13 and 29.
Judge Azura Alwi allowed the accused bail of RM45,000 with one surety and imposed an additional condition that he must not interfere with or contact any prosecution witnesses.
The court fixed Oct 5 for mention of the case.
