KUALA LUMPUR: The Negri Sembilan Dewan Keadilan dan Undang (DKU) and its secretary have applied to intervene in a legal action by three former Undang and a serving Undang, who are seeking to compel the Mentri Besar to sign a proclamation removing the Yang di-Pertuan Besar Negri Sembilan, Tuanku Muhriz Tuanku Munawir, as the state Ruler.
The DKU and its secretary Raja Norazli Raja Nordin filed the application to intervene through Messrs Halim & Ismail on Aug 6.
They are seeking to intervene in a leave application to commence judicial review by the four men - Datuk Mubarak Thahak, Datuk Maarof Mat Rashid, Datuk Abd Rahim Yasin and Datuk Muhammed Abdullah (who is still serving) - which was filed on July 17 and named the mentri besar and the state government as respondents.
In the judicial review application, the four were seeking a court order compelling the Mentri Besar to recognise Tuanku Muhriz's removal and the validity of the proclamation recognising Tunku Nadzaruddin Tuanku Jaafar as his successor under the state Constitution.
Meanwhile, in its intervention application, the DKU and Raja Norazli claimed they had a direct interest in the judicial review and would be directly affected by any orders made by the court.
The applicants also claimed that the four men did not have locus standi to file the leave application for judicial review.
Senior federal counsel Nurhafizza Azizan told the press that the High Court had advised the applicants during a case management today to discuss and decide whether to continue the case here or to transfer it to the Seremban High Court.
"The court has fixed Oct 7 for the applicants to update the court on the matter," she said.
It was reported that the leave for judicial review application was supported by an affidavit affirmed by Muhammed, who claimed that he and the three others attended a DKU meeting chaired by Tuanku Muhriz on March 5, where Mubarak allegedly raised several purported violations of adat.
Muhammed claimed the meeting became heated before the four left and gathered at Balai Undang Sungai Ujong, where they discussed the alleged offences and concluded that Tuanku Muhriz was no longer qualified to remain Yang di-Pertuan Besar.
The four men sought a mandamus order to compel the Mentri Besar to sign a document to remove Tuanku Muhriz and subsequently install Tunku Nadzaruddin as the 12th Yang di-Pertuan Besar Negri Sembilan.
