Army denies former staff sergeant's claim of active service status

KUALA LUMPUR: The Malaysian Army (TDM) has denied claims by former staff sergeant K. Vegeneswaran that he remains an active serviceman, maintaining that his service was lawfully terminated in accordance with existing regulations.

In a statement on Tuesday (Aug 4), the Army dismissed as baseless allegations made by Vegeneswaran in a video uploaded to the TikTok channel 'Nambikkai' on July 23, in which he claimed that the TDM, the Malaysian Armed Forces (ATM), and the government had defied a Court of Appeal ruling.

The Army clarified that the Court of Appeal's decision on May 25, 2023, only set aside the earlier dismissal on procedural grounds and did not overturn the disciplinary finding against Vegeneswaran, who had tested positive for methamphetamine and amphetamine in a drug screening confirmed by the Pathology Department of Kepala Batas Hospital.

"Following the court's decision, the Army took action in accordance with the Armed Forces (Terms of Service of Regular Forces) Regulations 2013 by terminating his service through the standard process upon the completion of his full-time service period of 18 years.

"All outstanding salary, allowances, and other benefits he was entitled to were duly paid and accepted without any objection or dispute at the time,” the statement said.

The Army also rejected claims that Vegeneswaran remained an Army member because he still possessed the MyTentera card, stressing that a person's military status is determined by law and official service records, not by possession of a military identification card.

It explained that the MyTentera card remained in his possession because he had yet to complete the discharge documentation process.

The Army further emphasised that individuals whose service has been terminated are no longer entitled to represent themselves as serving personnel.

It warned that using a MyTentera card or wearing a military uniform to imply active service may constitute an offence under the Penal Code and could result in investigation and legal action.

Reaffirming its commitment to upholding the rule of law, the Army said it respects all court decisions and acts in accordance with the law and established regulations.

It also urged the public not to speculate or spread inaccurate information that could cause confusion or tarnish the image and reputation of the Malaysian Armed Forces.- Bernama
