Security guard gets four months’ jail for hitting wife


MELAKA: A 36-year-old security guard was sentenced to four months’ imprisonment by the Magistrate’s Court in Ayer Keroh here after pleading guilty to hitting his wife for refusing to give him money to buy drugs.

Magistrate Sharda Shienha Mohd Suleiman meted out the sentence after the accused, Faizzul Ridwan Ab Rahman admitted to the charge on Thursday (May 28).

According to the charge, the accused intentionally caused injury to his 41-year-old wife at a house in Kampung Paya Rumput in the Melaka Tengah district at about 8am on May 24.

The charge was framed under Section 323 of the Penal Code, read together with Section 326A of the same Code.

Section 323 carries a punishment of up to one year’s imprisonment or a fine of RM2,000, or both, while Section 326A provides for a jail term of up to twice the maximum sentence upon conviction for offences involving domestic violence.

Based on the facts of the case, the accused had asked his wife for money to purchase drugs, but she refused as she did not have any cash.

The accused then used his wife’s mobile phone to contact her mother and younger sibling to borrow money, but his calls were ignored after family members ended the conversation.

Prior to the incident, the accused had kicked his wife on the thigh after she refused to speak to her mother to ask for a loan and had also forced her to go out and find RM100 for him to buy drugs.

The court also heard that the accused ordered his wife to pay a RM1,000 fine related to a separate drug case he is currently facing trial and threatened to burn her motorcycle if she failed to do so.

Inspector Nur Zaidah Muhamad Zailani prosecuted, while the accused was represented by lawyer Muhammad Izzuddin Ab Malek.
