Court sets Aug 18 to hear Fahmi Zainol's trial for allegedly assaulting wife


BALIK PULAU: The Magistrate’s Court here has fixed Aug 18 for the trial of Pantai Jerejak assemblyman Fahmi Zainol, who is accused of intentionally causing hurt to his wife on Feb 22.

Magistrate Chia Huey Ting also set May 14 for the submission of documents, including the medical report related to the case.

Fahmi, who is the former state agrotechnology, food security and cooperative development committee chairman, arrived at the Balik Pulau court complex accompanied by his wife at about 8.50am on Tuesday (Apr 28).

During proceedings, his lawyer, Dr Shamsher Singh Thind, said the two-month postponement had caused unnecessary delay and urged the court to fix an earlier date

"If the case is postponed again for another two months just for mention, it will continue to drag on without necessity.

"It should be noted that the complainant is the prosecution’s main witness, so the issue of withdrawing the report must be considered.

"It would be easier for the husband and wife to return to their original relationship if this case can be resolved quickly,” he said.

He added that the complainant had lodged two police reports, before and after the incident, and that there had been attempts to withdraw the report, noting that the case involved a domestic conflict and did not require intervention from higher authorities.

Meanwhile, Deputy Public Prosecutor Ikmal Affendi Zulkifly said the medical report is expected to be obtained within the week.

The court then set May 14 for submission of documents, including the medical report, while Aug 18 was fixed for trial, with the prosecution directed to submit available documents first.

On Feb 27, Fahmi was charged in the Magistrate’s Court with intentionally causing hurt to his wife, to which he pleaded not guilty.

He allegedly caused injury to his wife, Nur Hidayah Abd Jabar, 35, at a house in Persiaran Pantai Jerejak 11, Bayan Lepas, at about 10pm on Feb 22.

The charge, framed under Section 323 of the Penal Code for voluntarily causing hurt, was read together with Section 326A, which provides for enhanced penalties in cases involving domestic violence.

The court allowed bail at RM2,000 with one surety.
