Burger seller ordered to enter defence for murdering woman during robbery


SIBU: A burger seller has been ordered to enter his defence for the murder of a woman during a robbery.

High Court judge Justice Wong Siong Tung ruled on Monday (March 30) that the prosecution, led by DPP Mark Kenneth Netto, had successfully established a prima facie case against William Tinggi, 30, at the end of its case.

"Pursuant to Section 180 of the Criminal Procedure Code (CPC) and having heard the evidence presented at the close of the prosecution's case... the Court finds that a prima facie case has been made out... against the accused in respect of the charge brought against him, namely for an offence under section 302 of the Penal Code.

"Accordingly, the accused ought to be called to enter his defence under Section 180 of the CPC," Justice Wong ruled.

The court then set June 23 and 24 for the defence to present its case.

According to the charge sheet, the accused and two others had planned to go to a mini-mart in Sibujaya at 3pm on Feb 23 to commit robbery.

They saw shopkeeper Angela Joseph, 25, ordering food from a stall next to her shop.

The accused then allegedly pounced on her and stabbed her multiple times with a kitchen knife before robbing her of RM150, which he later split with his accomplices.

Following a police report lodged by a member of the public, the accused was arrested on the evening of Feb 24 at his home in Sibujaya.

In a separate case, the court ordered an accused drug trafficker to enter his defence on two charges.

Justice Wong also ruled that the prosecution had established a prima facie case against the accused.

Raymond Yew Her Hong stands accused of trafficking 175.05g of methamphetamine at 2.15am on June 12, 2023 in an apartment.

The charge was framed under Section 39B (1) (A) of the Dangerous Drug Act 1952, punishable under Section 39B (2) of the same Act.

The second charge, under Section 12(2) of the same Act, is for trafficking 109.83g of ketamine at the same place and time.

The court fixed July 27 and 28 for the defence to submit its case.
