PETALING JAYA: The psychiatric report for a male student accused of fatally stabbing a female student at a school is still pending, the Magistrate’s Court was told.
Lawyer Kitson Foong, who represents the underaged accused, informed Magistrate Amira Sariaty Zainal of the matter during a closed-door proceeding yesterday.
Speaking to the press later, Foong said the court has the authority under Section 34(2) of the Criminal Procedure Code to grant additional time for the psychiatric report to be completed.
“The proceedings have been postponed to Dec 19 in the hope that the report will be ready by then,” he said.
Foong explained that two assessments are required: the first to determine his client’s mental fitness to enter a plea and stand trial, and the second to assess his mental state at the time of the alleged offence.
On Oct 22, the 14-year-old was charged at the Magistrate’s Court with murdering a schoolmate at a school in Bandar Utama.
According to the charge sheet, the teenager allegedly killed the 16-year-old in a female students’ toilet between 9.20am and 9.35am on Oct 14.
The charge, under Section 302 of the Penal Code, carries the death penalty or imprisonment of between 30 and 40 years and 12 strokes of the cane, if convicted.
The court previously ordered the accused to undergo a psychiatric evaluation at Hospital Bahagia Ulu Kinta in Perak.
