Sibu man to be sentenced on Oct 1 for drug trafficking, possession

SIBU: A 37-year-old man is facing the gallows after being convicted on four counts of drug trafficking and possession.

High Court judge Wong Siong Tung in the ruling of the case on Friday (Sept 26) fixed Oct 1 for sentencing.

He said the prosecution has proven beyond a reasonable doubt on the four charges under the Dangerous Drugs Act 1952 (DDA).

In the first charge, the accused John Ting Sing Fong, a car accessories dealer, was accused of trafficking in 70.78gm of methamphetamine under Section 39B(1)(a) of the DDA 1952, which carries a death penalty or life imprisonment upon conviction.

The remaining three charges were for drug possession of 26.47gm of ketamine, 119.59gm of ketamine, and 1.55gm of MDMA under Section 12(2) of the DDA 1952.

The Section provides for imprisonment of up to five years or a fine not exceeding RM100,000, or both, if found guilty.

All offences were committed at about 8am on May 8, 2023 in a car behind a commercial building in Jalan Pahlawan.

In his decision, judge Wong said after considering the evidence as a whole, including oral and written submissions from both the prosecution and the defence, the Court concluded that the accused had failed to raise any reasonable doubt on his possession of the drugs or to rebut the presumption of trafficking in relation to the methamphetamine charge.
