KUALA LUMPUR: The Shah Alam High Court has issued an interim order against the Defence Minister and the Ministry not to issue statements regarding the death of Syamsul Haris Shamsudin, a Universiti Teknologi Malaysia Reserve Officers' training unit cadet.
Shah Alam High Court judge Justice Adlin Abdul Majid, granted the gag order applied by Ummu Haiman Bee Daulatgun, 45, during case management here on Thursday (Sept 18).
Her lawyer Datuk Naran Singh confirmed that the interim order was granted until Sept 26.
"Today we obtain the order until the Defence Minister would issue a letter of undertaking that he would not be making any more statements," Naran told the media when contacted.
Naran said the application was filed on Sept 9 and the Defence Minister was named as the sole respondent.
He said the basis of the application was that parties should not be making any statements as the case was still under investigation.
"If the Ministry agrees to come out with an undertaking that no further statements would be issued, we would be satisfied," Naran added.
The case has been fixed for another case management on Sept 26.
On Aug 26, the Shah Alam High Court allowed an application by Ummu Haiman to have her son's grave exhumed for a second post-mortem.
In her notice of motion filed on Aug 14, Ummu Haiman is seeking an order for Hospital Kuala Lumpur forensic experts to conduct the post-mortem in the presence of forensic expert Datuk Seri Dr Bhupinder Singh and her appointed lawyer, Naran.
She is also requesting that the experts produce their report within a month after post-mortem, and that a copy of the report be given to the law firm.
Ummu Haiman is also seeking for a special task force to be set up to investigate her son’s death, and for an inquest to be held.
Syamsul Haris, 22, from Universiti Teknologi Malaysia died while training at the Army Combat Training Centre in Ulu Tiram on July 28.
Johor police had said that a post-mortem found no signs of criminal injury but Ummu Haiman publicly called for an inquiry after finding “mysterious bruises” on her son’s body.
