Senior citizen jailed, fined for causing drink-driving accident


KOTA KINABALU: An elderly man has been jailed 30 days and fined RM10,000 in default three months’ jail for driving while drunk and causing an accident in Tawau district.

Lim Shui Sang, 65, pleaded guilty to the charges read before Tawau Magistrates Court judge Dayang Aidaku Amira Ami­nuddin yesterday.

In the charge sheet, Lim was accused of causing an accident near Simpang Lorong Delima in Tawau, about 450km from here, at around 7.30pm on July 21, 2024.

He had crashed into and caused injuries to a motorcyclist.

Upon investigation, Lim was found to be driving under the influence of alcohol, with testing showing that he had 167mg of alcohol per 100ml of blood, exceeding the limit of 50mg/100ml.

For this, the 65-year-old was charged under Section 45A (1) of the Road Transports Act 1987 for driving or trying to drive whilst intoxicated beyond the legal limit.

He could be jailed up to two years and fined up to RM30,000 upon conviction.

The case was prosecuted by Asst Supt Joan Lee while Lim was represented by counsel Jhesseny P. Kang.

Lee had asked the court for a high jail sentence as a lesson to the accused and as a deterrent for other road uses.

The magistrate ordered Lim to serve a 30-day jail term and pay RM10,000 in fine, or serve another three months in jail if he failed to pay, apart from having his driver’s licence suspended for two years.
