Man walks free on drug trafficking charge in Sandakan


KOTA KINABALU: A 27-year-old walked out of the Sandakan High Court a free man on Wednesday (Oct 30) after he was acquitted of a drug trafficking charge without having to enter his defence.

Justice Saiful Azian Mokhtar found that the prosecution had failed to establish a prima facie case against Mohd Amirul Mohd Yussof at the end of its case.

He said the prosecution had not presented sufficient evidence to sustain the charge under Section 39B (1) (a) of the Dangerous Drug Act 1952.

Amirul faced the death penalty if convicted.

He pleaded not guilty when he was charged in the High Court on Oct 4, 2022, with the trial date set for April 20 this year.

According to the charge sheet, he was accused of distributing 67.78g of methamphetamine beside a shop at the Mile 32 checkpoint in Sandakan at 1.30pm on April 20, 2022.

The prosecution was represented by DPP Mohd Azizi Hamil while Mohamed Zairi Zainal Abidin represented Amirul.
