GISB CEO, wife file habeas corpus petition, challenge arrest


JOHOR BARU: The chief executive officer of GISB Holdings Sdn Bhd (GISB), Datuk Nasiruddin Mohd Ali, filed a habeas corpus application at the High Court on Wednesday (Oct 30) to challenge his arrest under the Security Offences (Special Measures) Act (Sosma) 2012.

The defence team presented a notice of the habeas corpus application for Nasiruddin; his wife, Datin Azura Md Yusof, 57; and another applicant, Mohamad Suhaimi Mohd Sani, 28. They named the Home Affairs Minister, the Inspector-General of Police, the Public Prosecutor, the Selangor State Prison director, the Kuala Lumpur Region, and the Malaysian government as respondents, reported Sinar Harian.

The application requests an order for a writ of habeas corpus to release the applicants from what they claim was an unlawful arrest and detention. Justice Datuk Abu Bakar Katar has scheduled the hearing for Dec 4, allowing both the applicants and respondents’ lawyers to present their arguments.

The respondents were represented by Federal Attorney Mohamad Firdaus Saidani Ali and three lawyers from the Malaysian Bar Council: R Jayabalan, Fadhil Ihsan Mohamad Hassan, and Khairul Azwad, who monitored the proceedings for public interest.

Datuk Rosli Kamaruddin, one of the applicants' lawyers, stated that several affidavits would be filed to support the habeas corpus application before the hearing on Dec 4. He also mentioned that similar applications would be filed in Selangor and Kuala Lumpur in the near future.

"We filed the habeas corpus application in Johor Baru because the investigation also involves cases in this area, and the business premises under investigation are located here. This is the right of the accused to contest the arrest made against them. An application will also be made to dispute the charges related to organised crime," he explained.

On Oct 23, Nasiruddin, Azura and Suhaimi were accused of being members of an organised crime group under Act 130V (1) at the Selayang Sessions Court. However, no confessions were recorded from them or the 19 other individuals involved, as Sosma places jurisdiction of the case under the High Court.

According to the charges, all 13 men and nine women were alleged members of an organised crime group operating at 33-B Jalan Desa 1/1, Bandar Country Homes Rawang, between October 2020 and Sept 11 this year.
