KUALA LUMPUR: Five police officers including an assistant superintendent were charged at the Sessions Court with robbing a Chinese national last month.
Kpl Khairil Annuar Sulaiman, 39, Kpl Mohd Zaidi Jamaluddin, 35, Kpl Mohd Adrafil Adlan Roslan, 28, Kpl Ahmad Rohafiz Abdul Rani, 39, and Asst Supt Mohd Faizol Ismail, 41, pleaded not guilty to a charge before Sessions Court judge Hamidah Mohamed Deril here yesterday.
According to the charge sheet, they robbed Zhang Chenxuan (female) of RM140,000 in cash at a condominium unit in KL Trillion, Jalan Tun Razak here, at about 5.30pm on April 6.
They were jointly charged under Section 395 of the Penal Code and face a maximum 20 years’ imprisonment and whipping, if convicted.
Deputy public prosecutor Muhammad Muhairi Mohamed Noh asked the court to set bail at RM20,000 each in two sureties.
He also applied for their passports to be surrendered to the court and an order for them not to harass the victim and prosecution witnesses until the case is disposed of.
In mitigation, lawyer Gurmukh Singh Sandhu, who represented Kpl Khairul Annuar, Kpl Mohd Zaidi, Kpl Ahmad Rohafiz and ASP Mohd Faizol, pleaded for a lower bail amount.
He said a RM20,000 bail was exorbitant as his clients earned between RM2,000 and RM2,500 monthly.
The lawyer said the men were breadwinners of their families and that Kpl Khairul Annuar and Kpl Mohd Zaidi have autistic children.
“The bail amount, which is to ensure their attendance, should not be excessive.
“I humbly ask the court to consider their monthly salaries and to set a reasonable amount.
“All four will not abscond and they will cooperate with the police. They will not harass the victim,” Gurmukh said.
Meanwhile, lawyer Shah Rizal Abdul Manan, who represented Kpl Mohd Adrafil, said his client’s presence in court showed his responsibility in facing the charge.
“They are serving policemen who are aware of the consequences if they were to abscond.
“I ask the court to consider their backgrounds and impose minimal bail,” he said.
Judge Hamidah fixed bail at RM8,000 in one surety for each of the accused.
The court also allowed the prosecution’s application for additional conditions.
The case is fixed for mention on June 20.
