KULAI: The Communications and Digital Ministry will be working with the police to investigate the circulation of a video involving a couple who were allegedly engaged in an indecent act at a car park in Pasir Gudang.
Its deputy minister Teo Nie Ching said the Malaysian Communications and Multimedia Commission (MCMC) has deemed the video “pornographic”, which is a violation under Section 233 of the Communications and Multimedia Act.
Under Section 233, she said unlawful acts included the uploading of content with the intent to offend others or those that were pornographic in nature.

“So anyone who uploads such content on social media can be investigated and charged under this section,” she told reporters after attending a programme at Felda Bukit Batu here yesterday.
Teo said the MCMC is urging people to stop spreading the video as it is an offence to do so.
Section 233 of the Act outlines the improper use of network facilities or services.
It is an offence that upon conviction carries a maximum fine of RM50,000, a maximum jail term of one year, or both, and a further fine of RM1,000 for each day the offence continues.
On April 6, police detained a couple for allegedly engaging in an indecent act at a car park in Taman Kota Masai on March 29.
Prior to this, a brief video of the indecent act went viral on social media.
News reports stated that a 22-year-old man and a 17-year-old girl were being investigated under Section 377D of the Penal Code for gross indecency with another person.
However, Tebrau MP Jimmy Puah Wee Tse said yesterday that Section 377D of the Penal Code would be “too harsh”.
“They have not beaten anyone, committed theft or sold drugs.
“They should be given a second chance since they are still young. I don’t want to interfere (with the investigation), but maybe there are other charges that are more suitable for their case,” he said.
Seri Alam OCPD Supt Mohd Sohaimi Ishak, when contacted, said police would come out with a statement.
“Let us finish the investigation first, then we will issue a statement immediately,” he said.
