PORT DICKSON: Two undocumented Myanmar nationals were jointly charged at a Magistrate's Court here with the murder of a 44-year-old dragonfruit farm owner.
No plea was recorded from Yan Mai, 19, and Maung Piaw, 20, after the charge was read to them in Bahasa Malaysia before magistrate V. Vanita.
The accused allegedly murdered Low Seng Poh between 12.25am and 2am on Feb 18 at his farm in Tanah Merah Site A.
They were charged under Section 302 of the Penal Code read together with Section 34 of the same legislation which carries the death penalty upon conviction.
The court then fixed May 3 for next mention pending the submission of the chemistry, forensic and post-mortem reports.
The victim's father lodged a report at around 3pm on Feb 18 after he found his son's lifeless body at the farm.
A police team was immediately sent to the scene and found the victim’s body with his hands and legs tied. There were also injuries to his head and body.
The victim's father last saw him alive on Feb 17 when he went to the deceased's farm to bring him dinner.
The deceased told his father that he had hired a Myanmar national to help him two weeks earlier but did not provide any other information.
Earlier, the accused and three other countrymen – Salai Tin Shwe, 49, Some Meingtun, 43 and Tun Shwe, 20 – were charged with entering Malaysia without a valid travel document.
They were charged with committing the offence at the district police station here at around 4pm on Thursday (March 2).
The five were charged under Section 6(1)(c) of the Immigration Act 1959/63 which carries a fine of not more than RM10,000 or a jail term of not more than five years or both upon conviction.
Both the murder accused and Some pleaded guilty to the illegal entry charge and were sentenced to serve six months in jail each.
However, the court fixed March 31 for next mention of the case against Salai and Tun after they asked for an interpreter as they did not understand Bahasa Malaysia.
Jiwan Kaur Malkith Singh prosecuted.
