Prince and mum settle lawsuit


KUALA LUMPUR: A Selangor prince, who sued his mother over shares worth RM2mil in construction company Sunshine Fleet Sdn Bhd, has withdrawn the suit.

Putera Azamuddin Shah Abdul Aziz, 29, and Datin Paduka Tengku Putri Arafiah Sultan Abdul Aziz Shah, 57, resolved the problems between them at the High Court here yesterday.

A consent judgment was entered between the prince and his mother before High Court judge Justice Mohamad Ariff Md Yusof on Oct 25 last year, in which she was to purchase Putera Azamuddin’s shares in Sunshine Fleet for RM2mil.

Putri Arafiah, the executive chairman of the company and a sister of Selangor ruler Sultan Salahuddin Abdul Aziz, refused to comply with the court order.

The prince immediately filed a claim for a specific performance to compel his mother to comply with the consent judgment.

On April 19, High Court judge Justice Amelia Tee Hong Geok Abdullah granted an order for specific performance to compel Tengku Putri Arafiah, within five days, to sign and abide by the sale and purchase agreement over the shares but she failed to do so.

Justice Amelia Tee granted the prince leave on June 23 for him to commence committal proceedings against his mother for her conduct.

Yesterday, the judge struck out the suit in chambers after a “full and final” settlement was reached between the parties on the RM2mil sales and purchase agreement of the company, the main contractor of the controversial Shah Alam Hospital project.

Tengku Putri Arafiah and Putera Azamuddin also resolved his application to cite her for contempt of court for failing to comply with a court order on the issue of the same shares.

Justice Amelia Tee recorded the terms of settlement between the parties after the prince also withdrew his committal proceedings against Tengku Putri Arafiah.

The court did not make any order as to costs.

Putera Azamuddin was represented by lawyer Datuk Rajan Navaratnam while his mother was represented by counsel Jasbeer Singh Kaura.

Rajan told reporters that both parties had resolved matters between them amicably and each had agreed to keep the terms of settlement confidential.

Putera Azamuddin said he was happy the matter had been settled. His mother was present in court.
