Swinging door leads to Tribunal’s full refund order


Lee unsatisfied with safety door that was not installed correctly.

AN investment of RM4,400 on a safety door became a source of frustration for a mechanic as the fixture was installed incorrectly.

Lee Kin Leong from Taman Mas in Gelang Patah, Iskandar Puteri, bought the door from a shop in Taman Mutiara Rini, Johor Baru.

“The individual panels of the door are supposed open inwards, but in my case, one swings out and the other swings in,” he said outside Johor Consumer Claims Tribunal at Menara Ansar in Johor Baru.

Lee, 56, who runs a motorcycle repair workshop in Taman Nusa Perintis, Gelang Patah, agreed to the purchase of the metallic black copper door and accessories.

He paid RM2,000 deposit in cash on Dec 9 last year, with the remaining RM2,400 settled fully on June 9.

“Workers came to my house on June 11 to instal the door, and it took them 30 minutes.”

Lee said he was shocked to find that both door panels did not swing inwards as they were supposed to.

The contractor told him the cement skirting where the panel should open inwards was uneven, hence it had to be installed that way.

“They should have informed me of the problem before starting work, instead of proceeding with it,” he said.

While the contractor was willing to uninstal the door for an additional RM200 fee, Lee refused the offer as it was the contractor’s mistake.

The claimant called the Taman Mutiara Rini shop on June 12 to complain about the shoddy work but did not receive a favourable response.

After Lee lodged a police report on the same day at Gelang Patah police station, a supervisor from the shop came to his house on June 17 to inspect the door installation.

“He acknowledged the mistake and the marketing manager also came on June 25, but they did not say anything would be done to rectify the problem,” said the claimant.

Lee filed the case with Johor Consumer Claims Tribunal on July 7, asking for the respondent to reimburse his RM4,400 payment for the door.

Tribunal president Hafez Zalkapli ordered the respondent to refund the money within two weeks, and the claimant to return the door to the respondent upon recei­ving the money.
