Employer in Brunei probed for requiring staff to work on rest days


BANDAR SERI BEGAWAN: The Labour Department has launched an investigation into an employer in the Belait District for allegedly requiring employees to work on their designated rest days, following an enforcement operation carried out last week.

The violation was uncovered during Operation Waspada 240/2025, conducted by the Law Enforcement Division of the Labour Department’s Belait branch on Wednesday (Dec 17) along Jalan Jaya Negara, Kuala Belait, to ensure compliance with the Employment Order, Chapter 278.

During an inspection at a fast-food outlet, officers detected three offences involving four workers, with the primary violation being the requirement for staff to work on rest days, contrary to Section 64 of the Employment Order.

The inspection also found that the employer failed to grant leave on gazetted public holidays and breached foreign worker licence conditions.

According to the department, one foreign worker hired as a labourer was assigned cashier duties, which contravenes the terms of the approved employment licence under Section 112(2).

Investigations are ongoing. If found guilty, the employer may face compound fines of up to BND1,000 for each offence.

Failure to pay the fines could result in the case being brought before the court.

The Labour Department reminded employers to uphold workers’ rights by ensuring rest days are respected, wages are paid on time, and statutory benefits such as public holiday leave, sick leave certified by medical practitioners, annual leave and return air tickets upon contract completion are provided in accordance with the law. - Borneo Bulletin/ANN
