Nine lawyers representing AKPS chief pro bono

SEPANG: Nine lawyers represented Malaysian Border Control and Protection Agency (AKPS) director-general Comm Datuk Seri Mohd Shuhaily Mohd Zain during proceedings at the Sepang Court Complex here on Wednesday (Oct 21).

Lawyer Datuk Rosal Azimin Ahmad said the legal team comprised friends who had known Mohd Shuhaily from their school and university days, as well as through their professional careers.

“We are all friends of Datuk Seri Mohd Shuhaily. We are school friends, university friends and work friends.

“We are here to give him the opportunity to defend himself, not to fight anyone, but to show our support,” he told reporters after the proceedings at the Sepang Court Complex here on Wednesday (Oct 21).

The defence team was led by lawyer Datuk Kitson Foong and included Datuk Rosal, Datuk Akberdin Abdul Kader, Datuk Yaacob Md Sam, Datuk Dr Baljit Singh Sidhu and Muhammad Rafique Rashid Ali.

The other members were Datuk Ahmad Zaidi Zainal, Md Yunos Shariff and Dr Badruzzaman Ishak.

Rosal said the legal team would not comment further as the case was now before the court.

He stressed that the principle of being innocent until proven guilty must be respected.

Rosal also said Mohd Shuhaily was in good spirits and had accepted the situation without blaming anyone.

“He is doing very well. The most important thing is his character. He said, ‘It’s okay, I’ll face it. If this is the price I have to pay, then I have to pay it. Let’s go,’” he said.

Rosal added that the legal team would wait for the relevant documents under Section 51A of the Criminal Procedure Code before discussing the next course of action, including possible representations.

He said the legal team was providing its services pro bono, at no cost.

As the alleged offences were compoundable, he said the legal process would take time.

The case was fixed for mention on Nov 25.

Earlier, Comm Mohd Shuhaily, 54, was charged with two counts of allegedly assaulting two Special Branch officers at Terminal 1 of Kuala Lumpur International Airport (KLIA) on Sept 28.

The court granted him bail of RM1,500 for each charge, bringing the total to RM3,000, with one surety for both charges.
