SEPANG: Border Control and Protection Agency director-general Comm Datuk Seri Mohd Shuhaily Mohd Zain is expected to continue carrying out his duties unless instructed otherwise by the relevant authorities following his court appearance, his lawyer said.
Datuk Rosal Azimin Ahmad, who represents Comm Mohd Shuhaily, said there was currently no court order preventing him from performing his duties.
"Administratively, I cannot comment on that. But for now, without any instruction to the contrary, he will continue to work as usual," he told reporters after proceedings at the magistrate's court here on Wednesday (Oct 21).
Rosal said any decision on Comm Mohd Shuhaily's service status would fall under the purview of the relevant authorities, including the Home Ministry and the Public Service Department.
He stressed that Comm Mohd Shuhaily was the person being summoned (OKS) in the case, adding that the court proceedings should be viewed in that context.
"People must understand that this is a case involving the person being summoned, under Section 323, it is a compoundable offence," he said.
Rosal said bail had been set at RM1,500 for each charge, with one surety covering both cases.
He said the legal team was awaiting documents under Section 51A of the Criminal Procedure Code before discussing the next course of action.
The case was fixed for mention on Nov 25.
Earlier, Comm Mohd Shuhaily pleaded not guilty at the magistrate's court here on Wednesday to assaulting two police officers last month.
According to the charges, Comm Mohd Shuhaily allegedly caused hurt to two police officers between 1.17pm and 1.35pm near counter J at Terminal 1, KL International Airport (KLIA), on Sept 28.
Comm Mohd Shuhaily is charged under Section 323 of the Penal Code and faces up to a year's imprisonment or a maximum fine of RM2,000, or both, if convicted.
The case follows the circulation of CCTV footage allegedly showing Comm Mohd Shuhaily confronting a person at KLIA Terminal 1.
Border Control confirmed the footage was genuine and said the incident occurred while Comm Mohd Shuhaily was inspecting preparations at KLIA ahead of the Bahrain Grand Prix in Malaysia.
