PUTRAJAYA: The Court of Appeal on Wednesday (Oct 7) upheld the 10-year jail sentence and two strokes of the rotan imposed on a businessman for robbing an engineer of valuables and RM9,000 cash.
A three-judge panel comprising Justice Datuk Azman Abdullah, K. Muniandy and Dean Wayne Daly dismissed Nur Muhd Rusydi Abdul Raman's appeal against the sentence imposed by the High Court.
Justice Azman, who delivered the court's decision, said there was no reason for the court to reduce the sentence as a child had been used as a threat during the commission of the offence, while a dangerous weapon was also used, which could have caused serious injury or death.
He said the offence was committed in an area where government servants reside and which also serves as the country’s administrative centre.
"The appellant had taken almost all the valuables, he said.
On Nov 7, 2024, the Sessions Court sentenced Nur Muhd Rusydi, 34, to 10 years in jail and two strokes of rotan after he pleaded guilty to a charge of robbing Mohd Hafidz Mohd Ismail, 44, of valuables and RM9,000 cash.
He was armed with a pair of grass-cutting scissors when he committed the offence.
On Oct 6 this year, the High Court dismissed his appeal against the sentence.
The offence was committed at a house in Jalan P16E, Presint 16, Putrajaya at 3am on Oct 27, 2024.
During the proceedings, Nur Muhd Rusydi was represented by lawyer Izleen Ismail from the National Legal Aid Foundation, while Deputy Public Prosecutor P.Sarulatha appeared for the prosecution. — Bernama
