Rubber tapper gets 12 months' jail for injuring, intimidating 65-year-old man

KUALA KRAI: A rubber tapper was sentenced to 12 months in prison by a Magistrate's Court here Tuesday (Oct 6) for intimidating and causing injury to a 65-year-old man by swinging a machete at him last Friday (Oct 2).

Magistrate Rais Imran Hamid imposed the sentence on Mohd Rezuan Muhamad @ Yusuf, 35, after he pleaded guilty to both charges, with the sentences to run concurrently from Tuesday.

For the first charge, Mohd Rezuan was accused of intimidating Abdulhadee Chedah, 65, by swinging a machete at a hut next to the Kuala Krai District Council landfill in Pahi here at about noon on Oct 2.

The charge, under Section 506 of the Penal Code, carries a maximum prison sentence of two years, or a fine, or both upon conviction.

For the second charge, he was accused of voluntarily causing hurt to the same victim under Section 323 of the Penal Code, which carries a maximum prison sentence of one year, or a fine of up to RM2,000, or both.

Deputy Public Prosecutor Mazlinda Mohd Nor sought a commensurate sentence, while National Legal Aid Foundation (YBGK) lawyer Farazalila Fauzi appealed for leniency, saying her client worked as a rubber tapper earning about RM150 a week.

The court sentenced him to 12 months in prison for the first charge and six months for the second, with both sentences to run concurrently from Tuesday.

According to the facts of the case, Mohd Rezuan had asked the victim about his child but became dissatisfied with the answer before pointing and swinging a machete several times and kicking the victim on the lip, causing injury. - Bernama
