KUALA LUMPUR: The High Court has fixed Oct 6 for the hearing of a judicial review application filed by the father of Mongolian Altantuya Shaariibuu, who seeks to compel the authorities to investigate or complete investigations into an affidavit and statutory declaration affirmed by one of Altantuya's murderers, former police inspector Azilah Hadri.
A check in the court's e-filing system showed that the matter would be heard before Justice Norliza Othman at 10am.
Lawyer Sangeet Kaur, who represented Dr. Shaariibuu Setev, confirmed the matter when contacted by the media.
On Oct 16, 2025, the High Court granted leave for Setev to commence judicial review proceedings to compel the police to investigate the additional affidavit and statutory declaration by Azilah, a former Special Action Unit (UTK) member.
In the additional affidavit dated Sept 24, 2024 and statutory declaration dated Oct 17, 2019, Azilah claimed that he received instructions from "the higher up" to execute a "covert operation" to "kill and eliminate the deceased".
The statutory declaration was part of the affidavit used to reduce his sentence from death to 40 years in jail and 12 strokes of the rotan on Oct 10 last year by the Federal Court.
Setev, in his judicial review application, named the Inspector-General of Police, the director of the Criminal Investigation Department, the police, the Attorney General, and the Malaysian government as the first to fifth respondents.
Based on the affidavit, Setev said that the police did not provide information on the status of the latest investigation conducted by the Criminal Investigation Department, Bukit Aman, in 2019 regarding the content of Azilah's additional affidavit.
If the investigation into the additional affidavit was still ongoing, he applied for a mandamus order to complete the inquiry within one month from the date of the court order.
He also requested a mandamus order for the police to provide detailed information on the latest status of Bukit Aman's investigation into Azilah's affidavit within seven days.
"If the police decide to classify the investigation papers as no further action or NFA, the applicant wants the reason for the action to be taken," said the affidavit.
Azilah was convicted in 2009 along with another former police officer, Corporal Sirul Azhar Umar, for the murder of Altantuya in Mukim Bukit Raja, Shah Alam, Selangor, between 10pm on Oct 19, 2006, and 1am the next morning.
