Malaysian Bar seeks separation of AG, public prosecutor to protect independence


KUALA LUMPUR: The separation of the offices of the Attorney General (AG) and the Public Prosecutor (PP) to safeguard prosecutorial independence is among 11 motions to be tabled at the Malaysian Bar’s 80th annual general meeting (AGM) on Saturday (March 14).

The motion, proposed by Malaysian Bar chairman Datuk Mohamad Ezri Abdul Wahab, also calls for politicians to be barred from appointment as AG.

The Bar has previously warned that combining the two roles creates structural tension, conflicts of interest and excessive executive control.

Earlier, the AGM was delayed when the required quorum was not met during the initial count.

Under Section 64(4) of the Legal Profession Act 1976, at least 500 members must be present for the AGM to proceed.

The quorum was still not met by 11am, prompting a recount at 11.15am before proceedings finally resumed at 12.15pm.

Meanwhile, according to the circular, other motions to be tabled include clarifying the Malaysian Bar’s stance on judicial appointments to safeguard judicial independence, as well as addressing executive interference in the Legal Profession Qualifying Board and legal education.
