KANGAR: Three Perlis state assemblymen who were stripped of their seats after being terminated by their party are taking the State Legislative Assembly and Speaker Rus’sele Eizan to court.
The three – Saad Seman (Chuping), Fakhrul Anwar Ismail (Bintong) and Mohd Ridzuan Hashim (Guar Sanji) – have filed an an originating summons over the declaration of casual vacancies in the seats they had represented under their former party, PAS.
The originating summons was filed by lawyer Mohd Jamil Yaacob of Messrs Srihana Mohamad & Partners at the Kangar High Court.
The three are seeking a declaration that Rus’sele’s decision to declare their seats vacant was improper, null and void, invalid and defective, as well as any other relief or orders deemed appropriate by the court, Bernama reported.
The suit names the Speaker as the first defendant and the Perlis State Legislative Assembly as the second defendant.
On Dec 25, Rus’sele announced that casual vacancies had occurred in the Chuping, Bintong and Guar Sanji seats after the membership of the three PAS assemblymen for those constituencies ceased with immediate effect in accordance with Clause (1)(a)(ii) of Article 50A of the Perlis State Constitution.
