Ex-convict jailed a month for drunk driving in Tawau


KOTA KINABALU: An ex-convict was jailed for a month and fined RM10,000 for drunk driving that caused an accident in Tawau on Dec 27 last year.

The 41-year-old Roslan Lenter, who was recently released from prison and under the supervision of a parole officer, was sentenced after pleading guilty before Magistrate Don Stiwin Malanjum at the Tawau Magistrates Court on Wed (Feb 12).

The magistrate court also ordered Roslan to another three months in jail if he failed to pay the fine, in addition to disqualifying the accused from holding a driving license for two years.

Roslan, who was driving an MPV, was accused of crashing into the rear of a van at Jalan Hilltop roundabout, Tawau at about 7pm on Dec 27.

He was charged under Section 45A (1) of the Road Transport Act (APJ) 1987, and if convicted can be jailed for two years and fined up to RM30,000.

According to the investigation report submitted to the court, a preliminary investigation showed negligence by the accused who was driving a car and suspected to be under the influence of alcohol.

A breathalyser test found that the alcohol content was two hundred and five milligrams of ethyl in one hundred millilitres of blood, well above the legal limit.

The prosecution was led by Asst Sup Joan Lee, while Roslan was unrepresented.

Lee had asked the court to impose a longer prison sentence as a lesson for the accused.

The magistrate then sentenced him to prison for one month and a fine of RM10,000 and three months in prison if he failed to pay the fine, in addition to disqualifying the accused from holding a driving license for two years.
