Investigation into Yap Xin Yuan’s death almost complete, says police


PETALING JAYA: The investigation into the death of teenager Yap Xin Yuan is nearly complete, with police awaiting full forensic analysis of CCTV footage and post-mortem reports.

Selangor police chief Comm Datuk Hussein Omar Khan said the police have sent the CCTV and forensic reports for further analysis.

"We are still waiting for the post-mortem report from the hospital," he said during a press conference after launching the Selangor Ops Selamat campaign for the Lunar New Year celebration on Saturday (Jan 25).

Comm Hussein added that preliminary post-mortem results revealed traces of MDMA in the victim's body.

"We need experts to determine whether the victim died due to an overdose or other reasons. That is why we need a detailed, full post-mortem report. We are also recording statements from other individuals," he said.

While the two suspects - the victim's boyfriend and his brother - have been released on police bail, it does not mean they will not be charged, Comm Hussein said.

"Once all the reports are obtained, we will refer the investigation paper back to the deputy public prosecutor. When we refer the IP to the DPP, we will recommend the suspects be prosecuted, but the decision will be made by the DPP," he added.

It was reported that the victim's 16-year-old boyfriend and his older brother would be freed on police bail as investigators have received further instructions about the investigation.

Kajang OCPD Asst Comm Naazron Abdul Yusof said the police bail includes a bond under Section 49 of the Criminal Procedure Code requiring them to appear in court at a time to be determined.

"However, investigators have received further instructions on the case. Two of the suspects have been freed on police bail following the expiration of their remand," he said.

The third suspect, believed to be the boyfriend's father, has been released, as he has become a prosecution witness, ACP Naazron said.

"The IP will be referred again to the prosecutors once the instructions have been fulfilled. We are taking thorough action to ensure that justice is served," he said.

The suspects were initially remanded until last Sunday but the period was extended to Saturday.

It was reported that the toxicology and post-mortem reports would determine whether 15-year-old Yap Xin Yuan died due to an altercation or possible drug use.

Selangor police chief Comm Datuk Hussein Omar Khan had said the reports were crucial to determine the cause of death.
