High Court sets May 14 to hear Hindraf de-registration case


KUALA LUMPUR: The government's bid to strike out an application filed by the Hindu Rights Action Force (Hindraf) over its de-registration will be heard before a different High Court judge on May 14.

Senior Federal Counsel Liew Horng Bin said that the application would be heard before Justice Hayatul Akmal Abdul Aziz following the elevation of its previous judge, Justice Ahmad Kamal Md Shahid, who is now a Court of Appeal judge.

The case was brought up for case management before Deputy Registrar Lee Ka Full online on Thursday (Jan 2).

When contacted, SFC Liew said the hearing, initially fixed for Jan 2, had been vacated following the new date.

The government filed the striking out application on Dec 11, 2023.

It claimed that the declaration sought by Hindraf is academic because no relief regarding the validity of the decision by Registrar of Societies (ROS) and the Home Minister was requested in the suit.

On Nov 3, 2023, Hindraf chairman P. Waytha Moorthy filed an originating suit and named the government, the ROS director-general, the Home Minister and the de facto Law Minister as respondents.

He claimed the ROS director-general and the Home Minister's decision to deregister Hindraf was invalid because it violated several provisions in the Federal Constitution.

On Jan 29, 2024, the High Court dismissed a judicial review application by Hindraf to challenge ROS' action.
