Former cop gets jail, fine for negligently causing colleague's death


SIBU: A policeman has been sentenced to two years in jail and fined RM10,000 in default six months' jail after he was convicted by the High Court here on Tuesday (Jan 31) on an amended charge of causing a colleague's death by negligence.

The accused Mohamad Nur Alif Mazlan, 27, was earlier charged under Section 302 of the Penal Code for the murder of Norhalim Tumiran, 25, at between 5.45pm to 6.30pm on May 6, 2021, at his rented house in Permai near here.

Judge Christopher Chin Soo Yin in presiding over the case convicted the accused under Section 304A of the Penal Code.

He also ordered the accused to serve the sentence from the date of his arrest on May 6, 2021.

In April 2021, the accused from Negri Sembilan, together with two of his colleagues, had just finished their police training and were newly reporting for duty at the Sibujaya Police Station.

They had rented a semi-detached single storey house in Permai.

At about 5.45pm on that day, the deceased dropped by at the said house to have his evening meal together with his friends.

Whilst waiting to have their meal, the deceased and another Amirulizwan Sulaiman had decided to play video games in the sitting room.

Shortly afterward, Amirulizwan saw the accused come out from his room with a pistol.

Amirulizwan then heard a loud sound, which he suspected to be a gunshot. He then saw the deceased’s head was bleeding.

Amirulizwan confronted the accused to ask him why he had discharged his pistol. The accused replied that he did not realise that the pistol was loaded with bullets.

The accused then went hysterical and proceeded to wash the said pistol in the kitchen. Later, Amirulizwan witnessed the accused return and remove the joystick of the video game from the deceased's grip.

The accused then placed the washed pistol onto the right palm of the deceased, who was at that time lying motionless.

A total of 17 witnesses had testified during the trial of the case.

The accused was represented by Ranbir Singh while Deputy Public Prosecutor Mark Kenneth Netto prosecuted the case.
