Aliff Syukri claims trial to uploading offensive Instagram posts


SEPANG: Celebrity businessman Datuk Seri Aliff Syukri Kamarzaman has been charged at the Sessions Court here with four counts of uploading offensive contents on his Instagram account, relating to his controversial music video titled "Kelepok Raya".

The 35-year-old pleaded not guilty after the charges were read out to him before Sessions judge Ahmad Rizki Abdul Jalil here on Thursday (Oct 13).

Aliff Syukri was accused of four counts of uploading four clips – all in relation to the music video – with intent to annoy others.

He allegedly posted the content on his Instagram account with the handle "aliffsyukriterlajaklaris" between April 13 and 21.

The clips were then viewed at the Malaysian Communications and Multimedia Commission headquarters in Cyberjaya on April 21.

All of the charges were framed under Section 233(1)(a) of the Communication and Multimedia Act 1998 whereby Aliff Syukri faces a maximum RM50,000 fine or a maximum of one year in jail, or both, if convicted.

He also faces a fine of RM1,000 for each day the offence continues after a conviction.

DPP Fazril Sani Mohamed Fadzil offered bail at RM10,000 for each offence.

Aliff Syukri's lawyer Hasshahari Johari Mawi told the court that his client was self-employed and has a wife with five children.

"There has never been an instance that he did not cooperate in this case.

"The court can see that he has appeared here today to face the charges," Hasshahari said.

The lawyer said Aliff Syukri was not a flight risk and many people depended on his business for their livelihood.

"This is only a summons case and the accused faces fines while the prison time is only at the court's discretion," he added.

Aliff Syukri's other lawyer Awang Armadajaya Awang Mahmud proposed bail of RM1,500 for each offence.

"Bail is not meant to be punitive. Our client will give his guarantee that he would attend each of the proceedings," he said.

Judge Ahmad Rizki fixed bail at RM5,000 for each of the charges.

In total, Aliff Syukri was made to pay RM20,000 bail in one surety.

The controversial figure, who wore a pair of dark slacks and a white shirt with rolled-up sleeves, arrived at the court at around 8.30am to face his charges.

He was seen smiling and chatting to the press while waiting for his bail to be processed.
