PETALING JAYA: The defence team is confident the Federal Court will allow an appeal to overturn the High Court decision to convict Datuk Seri Najib Razak, that was upheld in the Court of Appeal on Wednesday (Dec 8).
Lead counsel Tan Sri Muhammad Shafee Abdullah (pic) said during a press conference held via Zoom that he was confident then and is equally confident now that the team's Federal Court appeal will result in the judgment being overturned.
"I have attacked rather vigorously the decision the Court of Appeal made today.
"This was a case that went on six months ago and was only decided today.
"I have said to the Court of Appeal that the judgement made in the High Court was not competent as there were mistakes of law.
"I was confident then and I am confident now in our chances.
"There have been cases where decisions in the High Court that have been upheld by the Court of Appeal which then were thrown out by the Federal Court," he said.
Shafee was responding to questions from the press on the chances of the decision being overturned in the Federal Court.
Shafee said that in his career, about 50% of the time the decision was overturned at the Federal Court.
"I am not troubled by the concurrent decision and I am not fazed by this.
"This is a case that poses a difficulty in interpreting the law.
"If there is a doubt in the case, the decision must be in favour of the accused.
"If there is a doubt of the position of law being interpreted, it should be in favour of the accused.
"I hope the Federal Court would find it in their heart to hold this position," he said.
